About us. This website is operated by C & M Navigation Systems (“CMNAV”, “we”, “us”, “our”). Our store is hosted on Shopify, which provides the e-commerce platform enabling us to sell our products and services.
By accessing our website or purchasing from us, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the website or place an order. We may update these Terms at any time by posting a new version on this page; continued use constitutes acceptance.
1. Eligibility & conduct
- You must be at least the age of majority in your country of residence (18 in the UK) or have consent from a parent/guardian for use by minors.
- You must not use the site for unlawful purposes or introduce malware, scraping, or other harmful activity.
- We may refuse service, cancel orders, or restrict access where we reasonably believe there is fraud, abuse, or breach of these Terms.
2. Products, descriptions & availability
- We sell standalone sat nav devices (and accessories) and related update/services. Product images are illustrative; actual appearance may vary.
- Refurbished units: cosmetic marks may be present; functionality is equivalent to new unless stated otherwise. See our Warranty & Returns Policy for specific cover.
- We may change or discontinue products at any time. Listings are subject to availability.
3. Pricing, taxes & payment
- Prices are shown in GBP and include applicable UK taxes unless stated. Shipping is calculated at checkout per our Delivery Policy.
- We reserve the right to correct pricing or typographical errors. If a price error materially affects your order, we will contact you to cancel or reconfirm before dispatch.
- Payment is taken via our third-party processors (e.g., Shopify Payments, PayPal). Your card details are handled by them, not by us.
4. Orders & contract formation
- Your order is an offer to buy. A binding contract forms when we email a dispatch confirmation or ship the goods, whichever occurs first.
- We may decline or cancel an order (e.g., suspected fraud, stock errors, delivery restrictions). Any payment captured will be refunded.
5. Shipping, risk & title
- Delivery options and timeframes are set out in our Postage & Delivery Policy (e.g., Royal Mail Tracked 24/48, Special Delivery). Timeframes are estimates, not guarantees.
- Risk in the goods passes to you on delivery. Title passes once we receive full payment.
- Please check packages on receipt and report damage or shortages promptly with photos so we can assist with carrier claims.
6. Consumer cancellation (distance selling)
- If you are a UK consumer, you may cancel most online purchases within 14 days of delivery under the Consumer Contracts Regulations 2013.
- You must take reasonable care of goods and return them within 14 days of notifying cancellation. You are responsible for return postage unless the item is faulty; use a tracked service.
- We may deduct for diminished value if items are handled beyond what is necessary to inspect them (e.g., missing accessories, software alteration).
- Services (e.g., paid update services) begun with your express request during the cancellation period may be charged proportionately; fully performed services are non-cancellable once completed.
7. Warranty, returns & map updates
- New units: 12-month hardware warranty against manufacturing defects; 30-day change-of-mind returns (see policy for conditions).
- Certified refurbished: 3-month hardware warranty; 14-day change-of-mind returns.
- Map updates: Free lifetime updates apply to brand-new CMNAV units for the original purchaser as described in our Free Lifetime Map Updates Policy. Refurbished units can purchase updates (typically £25 incl. return postage) unless stated otherwise.
- Software configuration/updates performed by you or third parties may affect stability. If you require us to restore the standard CMNAV configuration, a service fee may apply as per policy.
8. Safety, routing & lawful use
- Always obey road signs and local laws. Sat nav routing is advisory and may not reflect temporary restrictions, closures, or weight/height limits.
- Do not interact with the device while driving. Mount it securely and ensure a clear view of the road.
- Live traffic features may depend on mobile data/TMC coverage and can be unavailable or inaccurate in some regions.
9. Software, licences & intellectual property
- Device software and content (maps, voices, skins, POI) are licensed, not sold. You may not copy, reverse engineer, resell, or distribute them except as permitted by law or licence.
- All website content is owned by CMNAV or licensors. You must not replicate or exploit it without written permission.
10. Third-party services
We rely on third parties (Shopify, payment processors, couriers, analytics). Their services are subject to their own terms and privacy notices. We are not responsible for third-party websites or services.
11. Prohibited uses
You must not use our website or products to: (a) break the law; (b) infringe IP rights; (c) harass, abuse, or discriminate; (d) transmit malware; (e) mine or scrape data without consent; (f) circumvent security; (g) misrepresent identity; or (h) interfere with others’ use of the Service.
12. Reviews, feedback & user submissions
By submitting reviews or feedback, you grant CMNAV a non-exclusive, royalty-free licence to use, reproduce, and publish that content for marketing and support purposes. Do not upload unlawful, defamatory, or infringing material. We may moderate or remove content at our discretion.
13. Service changes & errors
We may change product features, specifications, or availability. We may correct errors (including pricing, stock, shipping rates) and cancel affected orders with a refund if already paid.
14. Abuse, threats & zero-tolerance policy
We operate a zero-tolerance policy towards racist, discriminatory, abusive, threatening, or violent behaviour towards CMNAV personnel (online, by phone, or in person). We may refuse service, cancel orders, and report incidents to law enforcement. Evidence (emails, call logs, messages) may be preserved where lawful.
15. Limitation of liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law. Your statutory rights as a consumer are not affected.
Subject to the above, and to the maximum extent permitted by law:
- We are not liable for indirect or consequential loss (e.g., loss of profits, revenue, data, or business opportunity).
- For services and goods purchased from us, our total liability arising out of or in connection with your purchase shall not exceed the price paid for the product or service giving rise to the claim.
- We do not warrant uninterrupted or error-free operation of third-party networks/services (couriers, payment gateways, TMC/mobile traffic data).
16. Events outside our control (force majeure)
We are not responsible for delays or failure to perform due to events beyond our reasonable control (e.g., strikes, courier disruption, extreme weather, network outages, regulatory actions). We will take reasonable steps to minimise the impact and resume performance as soon as practicable.
17. Privacy
Your personal data is handled per our Privacy Policy and any regional addenda (e.g., CCPA, APPI, LGPD). Please read it to understand how we process your data.
18. Complaints & disputes
If you have a complaint, contact contact@cmnav.co.uk. We aim to resolve issues promptly and fairly. Consumers may also seek advice from Citizens Advice or pursue remedies in the small claims court where appropriate.
19. Governing law & jurisdiction
These Terms and any contract between us are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, except that consumers residing elsewhere in the UK may bring claims in their local courts under mandatory consumer law.
20. General
- Invalidity of any term does not affect the remainder (severability).
- No waiver of a breach is a waiver of any subsequent breach.
- These Terms (plus referenced policies) constitute the entire agreement between you and CMNAV for website use and purchases.
- We may transfer our rights/obligations to another entity; this does not affect your rights. You may not assign without our consent.
